COMMISSION IMPLEMENTING DECISION (EU) 2024/2909

of 22 November 2024

on the harmonised standards for gas boilers drafted in support of Regulation (EU) No 813/2013 and of Delegated Regulation (EU) No 811/2013

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 10(6) thereof,

Whereas:

(1) In accordance with Article 9(2) of Directive 2009/125/EC of the European Parliament and of the Council (2), gas boilers that conform to harmonised standards or parts thereof, the references of which have been published in the

Official Journal of the European Union

, are to be presumed to conform to the relevant requirements of the applicable implementing measure to which such standards relate referred to in Article 9(2) of that Directive and set out in Annex VII to that Directive, covered by those harmonised standards or parts thereof.

(2) In Implementing Decision C(2015) 2626 (3), the Commission requested that the European Committee for Standardisation (CEN) draft harmonised standards in support of the implementation of Commission Regulation (EU) No 813/2013 (4) laying down ecodesign requirements for space heaters and combination heaters and of Commission Delegated Regulation (EU) No 811/2013 (5) with regard to the energy labelling of space heaters, combination heaters, packages of space heater, temperature control and solar device and packages of combination heater, temperature control and solar device.

(3) On the basis of the request set out in Implementing Decision C(2015) 2626 final, CEN has published adapted standards (6), in particular the standard EN 15502-1:2021+A1:2023 regarding gas-fired heating boilers.

(4) The Commission together with the CEN has assessed whether this standard EN 15502-1:2021+A1:2023 drafted by the CEN complies with the request M/535 of 28.4.2015.

(5) The findings of this assessment are that the standard satisfies the requirements it aims to cover, set out in Regulation (EU) No 813/2013 and Delegated Regulation (EU) No 811/2013. It is therefore appropriate to publish the reference of this standard in the

Official Journal of the European Union

.

(6) Commission Communication 2014/C 207/02 (7) regarding the implementation of Regulation (EU) No 813/2013 and Delegated Regulation (EU) No 811/2013, refers to European standard EN 15502-1:2012 and some other European standards to give access to measurement and calculation methods before harmonised standards’ references are published in the

Official Journal of the European Union

. Standard EN 15502-1:2012 is obsolete, making the reference to it in Communication 2014/C 207/02 no longer relevant.

(7) Compliance with a harmonised standard confers a presumption of conformity to the corresponding essential requirements, including the safety objectives, set out in Union harmonisation legislation from the date of publication of the reference of the standard in question in the

Official Journal of the European Union

. This Decision should therefore enter into force on the day of its publication,

HAS ADOPTED THIS DECISION:

Article 1

The references of harmonised standards for gas boilers drafted in support of Regulation (EU) No 813/2013 and Delegated Regulation (EU) No 811/2013 listed in the Annexes to this Decision, are hereby published in the

Official Journal of the European Union

.

Article 2

This Decision shall enter into force on the day of its publication in the

Official Journal of the European Union

.
