DECISION OF THE EEA JOINT COMMITTEE No 141/2024

amending Annex XX (Environment) to the EEA Agreement [2024/2451]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2023/2849 of 12 October 2023 supplementing Regulation (EU) 2015/757 of the European Parliament and of the Council as regards the rules for reporting and submission of the aggregated emissions data at company level ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2023/2449 of 6 November 2023 laying down rules for the application of Regulation (EU) 2015/757 of the European Parliament and of the Council as regards templates for monitoring plans, emissions reports, partial emissions reports, documents of compliance, and reports at company level, and repealing Commission Implementing Regulation (EU) 2016/1927 ( 2 ) is to be incorporated into the EEA Agreement.

(3) Implementing Regulation (EU) 2023/2449 repeals Commission Implementing Regulation (EU) 2016/1927 ( 3 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(4) Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XX to the EEA Agreement shall be amended as follows:

The text of point 21awb (Commission Implementing Regulation (EU) 2016/1927) is replaced by the following:

‘ 32023 R 2449 : Commission Implementing Regulation (EU) 2023/2449 of 6 November 2023 laying down rules for the application of Regulation (EU) 2015/757 of the European Parliament and of the Council as regards templates for monitoring plans, emissions reports, partial emissions reports, documents of compliance, and reports at company level, and repealing Commission Implementing Regulation (EU) 2016/1927 ( OJ L, 2023/2449, 7.11.2023 ).’

The following point is inserted after point 21awc (Commission Implementing Regulation (EU) 2016/1928):

‘21awd.

32023 R 2849 : Commission Delegated Regulation (EU) 2023/2849 of 12 October 2023 supplementing Regulation (EU) 2015/757 of the European Parliament and of the Council as regards the rules for reporting and submission of the aggregated emissions data at company level ( OJ L, 2023/2849, 15.12.2023 ).’

Article 2

The texts of Delegated Regulation (EU) 2023/2849 and Implementing Regulation (EU) 2023/2449 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 13 June 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
