DECISION OF THE EEA JOINT COMMITTEE No 136/2024

amending Annex XIII (Transport) to the EEA Agreement [2024/2453]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2023/205 of 7 November 2022 supplementing Regulation (EU) 2019/1239 of the European Parliament and of the Council as regards the establishment of the European Maritime Single Window environment data set and amending its Annex ( 1 ) is to be incorporated into the EEA Agreement.

(2) Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XIII to the EEA Agreement shall be amended as follows:

The following is added in point 56la (Regulation (EU) 2019/1239 of the European Parliament and of the Council):

‘, as amended by:

— 32023 R 0205 : Commission Delegated Regulation (EU) 2023/205 of 7 November 2022 ( OJ L 33, 3.2.2023, p. 24 ).’

The following point is inserted after point 56la (Regulation (EU) 2019/1239 of the European Parliament and of the Council):

‘56laa.

32023 R 0205 : Commission Delegated Regulation (EU) 2023/205 of 7 November 2022 supplementing Regulation (EU) 2019/1239 of the European Parliament and of the Council as regards the establishment of the European Maritime Single Window environment data set and amending its Annex ( OJ L 33, 3.2.2023, p. 24 ).

The text of the Regulation shall, for the purpose of this Agreement, be read with the following adaptations:

(a) As regards the EFTA States, the column with the heading “UCC Annex B” in Section 2 of Annex II shall be optional.

(b) In Section 2 of Annex II, information in a data element regarding UCC code list and the GEONOM code list shall not apply to the EFTA States.’

Article 2

The text of Delegated Regulation (EU) 2023/205 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 13 June 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 157/2022 of 29 April 2022 ( 2 ) , whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
