DECISION OF THE EEA JOINT COMMITTEE No 129/2024

amending Annex IX (Financial services) to the EEA Agreement [2024/2483]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2022/1855 of 10 June 2022 supplementing Regulation (EU) No 648/2012 of the European Parliament and of the Council with regard to regulatory technical standards specifying the minimum details of the data to be reported to trade repositories and the type of reports to be used ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Delegated Regulation (EU) 2022/1856 of 10 June 2022 amending the regulatory technical standards laid down in Delegated Regulation (EU) No 151/2013 by further specifying the procedure for accessing details of derivatives as well as the technical and operational arrangements for their access ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Delegated Regulation (EU) 2022/1857 of 10 June 2022 amending the regulatory technical standards laid down in Delegated Regulation (EU) No 150/2013 as regards the details of the applications for registration as a trade repository and for applications for extension of registration as a trade repository ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Delegated Regulation (EU) 2022/1858 of 10 June 2022 supplementing Regulation (EU) No 648/2012 of the European Parliament and of the Council with regard to regulatory technical standards specifying the procedures for the reconciliation of data between trade repositories and the procedures to be applied by the trade repository to verify the compliance by the reporting counterparty or submitting entity with the reporting requirements and to verify the completeness and correctness of the data reported ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Regulation (EU) 2022/1860 of 10 June 2022 laying down implementing technical standards for the application of Regulation (EU) No 648/2012 of the European Parliament and of the Council with regard to the standards, formats, frequency and methods and arrangements for reporting ( 5 ) , as corrected by OJ L 304, 24.11.2022, p. 102 , is to be incorporated into the EEA Agreement.

(6) Delegated Regulation (EU) 2022/1855 repeals Commission Delegated Regulation (EU) No 148/2013 ( 6 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(7) Annex IX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex IX to the EEA Agreement shall be amended as follows:

The text of point 31bce (Commission Delegated Regulation (EU) No 148/2013) is replaced by the following:

‘ 32022 R 1855 : Commission Delegated Regulation (EU) 2022/1855 of 10 June 2022 supplementing Regulation (EU) No 648/2012 of the European Parliament and of the Council with regard to regulatory technical standards specifying the minimum details of the data to be reported to trade repositories and the type of reports to be used ( OJ L 262, 7.10.2022, p. 1 ).’

The following indent is added in 31bcg (Commission Delegated Regulation (EU) No 150/2013):

‘—

32022 R 1857 : Commission Delegated Regulation (EU) 2022/1857 of 10 June 2022 ( OJ L 262, 7.10.2022, p. 41 ).’

The following indent is added in point 31bch (Commission Delegated Regulation (EU) No 151/2013):

The following points are inserted after point 31bcy (Commission Delegated Regulation (EU) 2021/1456):

Article 2

The texts of Delegated Regulations (EU) 2022/1855, (EU) 2022/1856, (EU) 2022/1857 and (EU) 2022/1858 and Implementing Regulation (EU) 2022/1860, as corrected by OJ L 304, 24.11.2022, p. 102 , in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 13 June 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 50/2021 of 5 February 2021 ( 7 ) , whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
