COMMISSION DECISION (EU) 2024/2089

of 31 July 2024

confirming the participation of Ireland in Regulation (EU) 2024/1348 of the European Parliament and of the Council establishing a common procedure for international protection in the Union

THE EUROPEAN COMMISSION,

Having regard to Protocol No 21 on the position of the United Kingdom and Ireland in respect of the Area of Freedom, Security and Justice, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and in particular Article 4 thereof,

Having regard to the notification by Ireland of its wish to accept and be bound by Regulation (EU) 2024/1348 of the European Parliament and of the Council of 14 May 2024 establishing a common procedure for international protection in the Union and repealing Directive 2013/32/EU (1),

Whereas:

(1) Regulation (EU) 2024/1348 was adopted on 14 May 2024 and entered into force on 11 June 2024. Its provisions are to apply from 12 June 2026.

(2) By letter of 27 June 2024, Ireland notified its wish to accept and be bound by Regulation (EU) 2024/1348.

(3) The participation of Ireland in Regulation (EU) 2024/1348 should therefore be confirmed.

(4) In order to ensure that Ireland’s participation can be taken into account in the adoption of implementing measures laying down rules for the application of Regulation (EU) 2024/1348, as regards establishing the adequate capacity of Member States and the maximum number of applications a Member State is required to examine in the border procedure per year, that are to be adopted in accordance with specific time-frames laid down in Regulation (EU) 2024/1348, this Decision should enter into force as soon as possible.

(5) There are no specific conditions attached to the participation of Ireland in Regulation (EU) 2024/1348 and no transitional measures are necessary,

HAS ADOPTED THIS DECISION:

Article 1

The participation of Ireland in Regulation (EU) 2024/1348 is confirmed.

Article 2

This Decision shall enter into force on the day of its publication in the

Official Journal of the European Union
