COMMISSION IMPLEMENTING DECISION (EU) 2024/1589

of 4 June 2024

on the harmonised standards for condensing units for refrigeration drafted in support of Commission Regulation (EU) 2015/1095

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 10(6) thereof,
Whereas:
(1) In accordance with Article 9(2) of Directive 2009/125/EC of the European Parliament and of the Council (2), Member States are to regard a product for which harmonised standards have been applied, the reference numbers of which have been published in the
Official Journal of the European Union
, as conforming to all the relevant requirements of the applicable implementing measure to which such standards relate. Article 4 of Commission Regulation (EU) 2015/1095 (3) and Annex VI thereto lay down the relevant measurement and calculation requirements for condensing units.
(2) By letter of amendment No 1 to M/495 of 2 October 2013 the Commission made a request to the European Committee for Standardisation (CEN), the European Committee for Electrotechnical Standardisation and the European Telecommunications Standards Institute for the drafting of harmonised standards in support of Commission Regulation (EU) 2015/1095.
(3) On the basis of the request M/495 Amendment No 1 of 2 October 2013, CEN revised standard EN 13215:2015 resulting in the adoption of standard EN 13215:2016+A1:2020 on the testing conditions for condensing units.
(4) The Commission together with CEN, has assessed whether the harmonised standard EN 13215:2016+A1:2020 complies with the request M/495 Amendment No 1 of 2 October 2013.
(5) The harmonised standard EN 13215:2016+A1:2020 satisfies the requirements which it aims to cover, and which are set out in Regulation (EU) 2015/1095. It is therefore appropriate to publish the reference of this standard in the
Official Journal of the European Union.
(6) In its Communication 2017/C 44/1 (4) the Commission published the titles and references of standards and transitional methods of measurement and calculation in order to provide manufacturers and national market surveillance authorities with supporting information for the enforcement of Regulation (EU) 2015/1095 and Commission Delegated Regulation (EU) 2015/1094 (5) until references of harmonised standards are published in the
Official Journal of the European Union
. Subsequent versions of those standards, apart from the standard on the testing conditions for condensing units, have been rejected by the Commission. That Communication should therefore be repealed from the date of entry into force of this Decision.
(7) Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the
Official Journal of the European Union
. This Decision should therefore enter into force on the date of its publication,
HAS ADOPTED THIS DECISION:

Article 1

The references of harmonised standards for condensing units for refrigeration, drafted in support of Regulation (EU) 2015/1095,listed in the Annex to this Decision, are hereby published in the
Official Journal of the European Union
.

Article 2

Communication 2017/C 44/1 is repealed.

Article 3

This Decision shall enter into force on the day of its publication in the
Official Journal of the European Union
.
