DECISION OF THE EEA JOINT COMMITTEE No 280/2023

amending Annex IX (Financial services) to the EEA Agreement [2024/1119]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2023/894 of 4 April 2023 laying down implementing technical standards for the application of Directive 2009/138/EC of the European Parliament and the Council with regard to the templates for the submission by insurance and reinsurance undertakings to their supervisory authorities of information necessary for their supervision and repealing Implementing Regulation (EU) 2015/2450 ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2023/895 of 4 April 2023 laying down implementing technical standards for the application of Directive 2009/138/EC of the European Parliament and the Council with regard to the procedures, formats and templates for the disclosure by insurance and reinsurance undertakings of their report on their solvency and financial condition and repealing Implementing Regulation (EU) 2015/2452 ( 2 ) is to be incorporated into the EEA Agreement.

(3) Implementing Regulation (EU) 2023/894 repeals Commission Implementing Regulation (EU) 2015/2450 ( 3 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(4) Implementing Regulation (EU) 2023/895 repeals Commission Implementing Regulation (EU) 2015/2452 ( 4 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(5) Annex IX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex IX to the EEA Agreement shall be amended as follows:

The text of point 1p (Commission Implementing Regulation (EU) 2015/2450) is replaced by the following:

‘ 32023 R 0894 : Commission Implementing Regulation (EU) 2023/894 of 4 April 2023 laying down implementing technical standards for the application of Directive 2009/138/EC of the European Parliament and the Council with regard to the templates for the submission by insurance and reinsurance undertakings to their supervisory authorities of information necessary for their supervision and repealing Implementing Regulation (EU) 2015/2450 ( OJ L 120, 5.5.2023, p. 1 ).’

The text of point 1r (Commission Implementing Regulation (EU) 2015/2452) is replaced by the following:

‘ 32023 R 0895 : Commission Implementing Regulation (EU) 2023/895 of 4 April 2023 laying down implementing technical standards for the application of Directive 2009/138/EC of the European Parliament and the Council with regard to the procedures, formats and templates for the disclosure by insurance and reinsurance undertakings of their report on their solvency and financial condition and repealing Implementing Regulation (EU) 2015/2452 ( OJ L 120, 5.5.2023, p. 1597 ).’

Article 2

The texts of Implementing Regulations (EU) 2023/894 and (EU) 2023/895 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 28 October 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
