DECISION OF THE EEA JOINT COMMITTEE No 12/2024

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1558]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2022/1426 of 5 August 2022 laying down rules for the application of Regulation (EU) 2019/2144 of the European Parliament and of the Council as regards uniform procedures and technical specifications for the type-approval of the automated driving system (ADS) of fully automated vehicles ( 1 ) is to be incorporated into the EEA Agreement.

(2) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following is inserted after point 52d (Commission Delegated Regulation (EU) 2021/1341) of Chapter I of Annex II to the EEA Agreement:

‘52e.

32022 R 1426 : Commission Implementing Regulation (EU) 2022/1426 of 5 August 2022 laying down rules for the application of Regulation (EU) 2019/2144 of the European Parliament and of the Council as regards uniform procedures and technical specifications for the type-approval of the automated driving system (ADS) of fully automated vehicles ( OJ L 221, 26.8.2022, p. 1 ).

The provisions of the Regulation shall, for the purpose of the EEA Agreement, be read with the following adaptation:

Notwithstanding the provisions of Protocol 1 to this Agreement, in point 5.4. of Part 2 of Annex III, the words “or the EFTA Surveillance Authority as regards manufacturers established in the EFTA States” shall be inserted after the words “the Commission”.’

Article 2

The text of Implementing Regulation (EU) 2022/1426 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 3 February 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 49/2022 of 18 March 2022 ( 2 ) , whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
