DECISION OF THE EEA JOINT COMMITTEE No 50/2024

of 15 March 2024

amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1576]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Regulation (EU) 2023/1719 of 8 September 2023 amending Annexes II and IV to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for isoxaben, metaldehyde, Metarhizium brunneum strain Ma 43, paclobutrazol and Straight Chain Lepidopteran Pheromones (SCLP) in or on certain products ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Regulation (EU) 2023/1753 of 11 September 2023 amending Annexes II and III to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for pyriproxyfen in or on certain products ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Regulation (EU) 2023/2086 of 28 September 2023 amending Annex II to Regulation (EC) No 1333/2008 of the European Parliament and of the Council and the Annex to Commission Regulation (EU) No 231/2012 as regards the use of buffered vinegar as a preservative and acidity regulator ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Regulation (EU) 2023/2379 of 29 September 2023 amending Annex II to Regulation (EC) No 1333/2008 of the European Parliament and of the Council and the Annex to Commission Regulation (EU) No 231/2012 as regards the food additive stearyl tartrate (E 483) ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Regulation (EU) 2023/2108 of 6 October 2023 amending Annex II to Regulation (EC) No 1333/2008 of the European Parliament and of the Council and the Annex to Commission Regulation (EU) No 231/2012 as regards food additives nitrites (E 249-250) and nitrates (E 251-252) ( 5 ) , as corrected by OJ L, 2023/90138, 28.11.2023 , is to be incorporated into the EEA Agreement.

(6) Commission Implementing Regulation (EU) 2023/1682 of 29 June 2023 concerning the renewal of the authorisation of dimethylglycine sodium salt as a feed additive for chickens for fattening (holder of the authorisation: Taminco BV) and repealing Implementing Regulation (EU) No 371/2011 ( 6 ) is to be incorporated into the EEA Agreement.

(7) Commission Implementing Regulation (EU) 2023/1712 of 7 September 2023 concerning the authorisation of Sunset Yellow FCF as a feed additive for cats, dogs, ornamental fish, grain-eating ornamental birds and small rodents ( 7 ) is to be incorporated into the EEA Agreement.

(8) Implementing Regulation (EU) 2023/1682 repeals Implementing Regulation (EU) No 371/2011 ( 8 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(9) This Decision concerns legislation regarding feedingstuffs and foodstuffs. Legislation regarding feedingstuffs and foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(10) Annexes I and II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The following indents are added in point 40 (Regulation (EC) No 396/2005 of the European Parliament and of the Council):

The following points are inserted after point 533 (Commission Implementing Regulation (EU) 2023/2662):

32023 R 1682 : Commission Implementing Regulation (EU) 2023/1682 of 29 June 2023 concerning the renewal of the authorisation of dimethylglycine sodium salt as a feed additive for chickens for fattening (holder of the authorisation: Taminco BV) and repealing Implementing Regulation (EU) No 371/2011 ( OJ L 217, 4.9.2023, p. 1 ).

The text of point 2za (Commission Implementing Regulation (EU) No 371/2011) is deleted.

Article 2

Chapter XII of Annex II to the EEA Agreement shall be amended as follows:

The following indents are added in point 54zzy (Regulation (EC) No 396/2005 of the European Parliament and of the Council):

Article 3

The texts of Regulations (EU) 2023/1719, (EU) 2023/1753, (EU) 2023/2086, (EU) 2023/2379 and (EU) 2023/2108, as corrected by OJ L, 2023/90138, 28.11.2023 , and Implementing Regulations (EU) 2023/1682 and (EU) 2023/1712 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 4

This Decision shall enter into force on 16 March 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
