DECISION OF THE EEA JOINT COMMITTEE No 74/2024

amending Annex XVIII (Health and safety at work, labour law, and equal treatment for men and women) to the EEA Agreement [2024/1596]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Directive (EU) 2019/1158 of the European Parliament and of the Council of 20 June 2019 on work-life balance for parents and carers and repealing Council Directive 2010/18/EU ( 1 ) is to be incorporated into the EEA Agreement.

(2) Directive (EU) 2019/1158 repeals Directive 2010/18/EU ( 2 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(3) Annex XVIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The text of point 31a (Council Directive 2010/18/EU) of Annex XVIII to the EEA Agreement is replaced by the following:

‘ 32019 L 1158 : Directive (EU) 2019/1158 of the European Parliament and of the Council of 20 June 2019 on work-life balance for parents and carers and repealing Council Directive 2010/18/EU ( OJ L 188, 12.7.2019, p. 79 ).

The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:

In Article 2, the words “and of the EFTA Court, in accordance with the EEA Agreement” shall be added after the words “the Court of Justice”.’

Article 2

The text of Directive (EU) 2019/1158 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 16 March 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
