DECISION OF THE EEA JOINT COMMITTEE No 94/2024

of 26 April 2024

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1914]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2024/235 of 15 January 2024 approving Alkyl (C 12-16 ) dimethylbenzyl ammonium chloride (ADBAC/BKC (C 12-C16 )) as an existing active substance for use in biocidal products of product-type 2 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2024/208 of 10 January 2024 postponing the expiry date of the approval of disodium tetraborate for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Decision (EU) 2024/222 of 12 January 2024 postponing the expiry date of the approval of boric acid for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Decision (EU) 2024/241 of 15 January 2024 not approving Willaertia magna c2c maky as an active substance for use in biocidal products of product-type 11 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 4 ) is to be incorporated into the EEA Agreement.

(5) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following points are inserted after point 12zzzzzzzzzzh (Commission Implementing Decision (EU) 2023/2052) of Chapter XV of Annex II to the EEA Agreement:

Article 2

The texts of Implementing Regulation (EU) 2024/235 and Implementing Decisions (EU) 2024/208, (EU) 2024/222 and (EU) 2024/241 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 27 April 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
