on confirming the participation of Ireland in Directive (EU) 2023/2843 of the European Parliament and of the Council amending Directives 2011/99/EU and 2014/41/EU of the European Parliament and of the Council, Council Directive 2003/8/EC and Council Framework Decisions 2002/584/JHA, 2003/577/JHA, 2005/214/JHA, 2006/783/JHA, 2008/909/JHA, 2008/947/JHA, 2009/829/JHA and 2009/948/JHA, as regards digitalisation of judicial cooperation
THE EUROPEAN COMMISSION,
Having regard to Protocol No 21, on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and in particular Articles 4 and 4a(1) thereof,
Having regard to the notification by Ireland of its wish to accept and be bound by Directive (EU) 2023/2843 of the European Parliament and of the Council of 13 December 2023 amending Directives 2011/99/EU and 2014/41/EU of the European Parliament and of the Council, Council Directive 2003/8/EC and Council Framework Decisions 2002/584/JHA, 2003/577/JHA, 2005/214/JHA, 2006/783/JHA, 2008/909/JHA, 2008/947/JHA, 2009/829/JHA and 2009/948/JHA, as regards digitalisation of judicial cooperation (1),
Whereas:
(1) By letter to the Commission of 11 December 2023, Ireland notified its wish, in accordance with Articles 4 and 4a(1) of Protocol No 21, to accept and be bound by Directive (EU) 2023/2843.
(2) Ireland’s wish to accept and be bound by Directive (EU) 2023/2843 can apply only in relation to the legal acts amended by that Directive in which Ireland participates and by which it is bound. It does not apply to the legal acts to which Ireland did not opt in, namely Directives 2011/99/EU (2) and 2014/41/EU (3) of the European Parliament and of the Council.
(3) There are no specific conditions attached to the participation of Ireland in Directive (EU) 2023/2843 and there are no transitional measures.
(4) The participation of Ireland in Directive (EU) 2023/2843 should be confirmed.
(5) In order to allow Ireland to apply Directive (EU) 2023/2843 as soon as possible, this Decision should enter into force on the day following that of its publication,
HAS ADOPTED THIS DECISION:
Article 1
The participation of Ireland in Directive (EU) 2023/2843 is confirmed.
Article 2
This Decision shall enter into force on the day following that of its publication in the
Official Journal of the European Union
