DECISION OF THE EEA JOINT COMMITTEE No 234/2023

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/987]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2022/1991 of 20 October 2022 approving didecyldimethylammonium chloride as an active substance for use in biocidal products of product-types 1 and 2 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Regulation (EU) 2023/1132 of 8 June 2023 amending Regulation (EC) No 1907/2006 of the European Parliament and of the Council as regards carcinogenic, mutagenic or reproductive toxicant substances subject to restrictions ( 2 ) is to be incorporated into the EEA Agreement.

(3) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XV of Annex II to the EEA Agreement shall be amended as follows:

The following point is inserted after point 12zzzzzzzzy (Commission Implementing Decision (EU) 2022/2298):

‘12zzzzzzzzz.

32022 R 1991 : Commission Implementing Regulation (EU) 2022/1991 of 20 October 2022 ( OJ L 273, 21.10.2022, p. 11 ).’

The following indent is added in point 12zc (Regulation (EC) No 1907/2006 of the European Parliament and of the Council):

‘—

32023 R 1132 : Commission Regulation (EU) 2023/1132 of 8 June 2023 ( OJ L 149, 9.6.2023, p. 49 ).’

Article 2

The texts of Regulation (EU) 2023/1132 and Implementing Regulation (EU) 2022/1991 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 23 September 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
