DECISION OF THE EEA JOINT COMMITTEE No 329/2022

amending Annex IX (Financial services) to the EEA Agreement [2023/1271]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Regulation (EU) 2021/2259 of the European Parliament and of the Council of 15 December 2021 amending Regulation (EU) No 1286/2014 as regards the extension of the transitional arrangement for management companies, investment companies and persons advising on, or selling, units of undertakings for collective investment in transferable securities (UCITS) and non-UCITS ( 1 ) is to be incorporated into the EEA Agreement.

(2) Directive (EU) 2021/2261 of the European Parliament and of the Council of 15 December 2021 amending Directive 2009/65/EC as regards the use of key information documents by management companies of undertakings for collective investment in transferable securities (UCITS) ( 2 ) is to be incorporated into the EEA Agreement.

(3) Annex IX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex IX to the EEA Agreement shall be amended as follows:

The following indent is added in point 30 (Directive 2009/65/EC of the European Parliament and of the Council):

‘-

32021 L 2261 : Directive (EU) 2021/2261 of the European Parliament and of the Council of 15 December 2021 ( OJ L 455, 20.12.2021, p. 15 ).’

The following indent is added in point 31bg (Regulation (EU) No 1286/2014 of the European Parliament and of the Council):

‘-

32021 R 2259 : Regulation (EU) 2021/2259 of the European Parliament and of the Council of 15 December 2021 ( OJ L 455, 20.12.2021, p. 1 ).’

Article 2

The texts of Regulation (EU) 2021/2259 and Directive (EU) 2021/2261 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 10 December 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 67/2020 of 30 April 2020 ( 3 ) , whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
