DECISION OF THE EEA JOINT COMMITTEE No 13/2023

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2023/2318]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Decision (EU) 2021/2267 of 17 December 2021 laying down the format for reporting data and information on the collected post-consumption waste of tobacco products with filters and of filters marketed for use in combination with tobacco products ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2022/162 of 4 February 2022 laying down rules for the application of Directive (EU) 2019/904 of the European Parliament and of the Council as regards the calculation, verification and reporting on the reduction in the consumption of certain single-use plastic products and the measures taken by Member States to achieve such reduction ( 2 ) is to be incorporated into the EEA Agreement.

(3) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following is inserted after point 9daa (Commission Implementing Decision (EU) 2021/1752) of Chapter XVII of Annex II to the EEA Agreement:

‘9db.

32021 D 2267 : Commission Implementing Decision (EU) 2021/2267 of 17 December 2021 laying down the format for reporting data and information on the collected post-consumption waste of tobacco products with filters and of filters marketed for use in combination with tobacco products ( OJ L 455, 20.12.2021, p. 32 ).

32022 D 0162 : Commission Implementing Decision (EU) 2022/162 of 4 February 2022 laying down rules for the application of Directive (EU) 2019/904 of the European Parliament and of the Council as regards the calculation, verification and reporting on the reduction in the consumption of certain single-use plastic products and the measures taken by Member States to achieve such reduction ( OJ L 26, 7.2.2022, p. 19 ).

The provisions of the Decision shall, for the purposes of this Agreement, be read with the following adaptation:

Articles 1 and 2(1) shall not apply to Liechtenstein.’

Article 2

The texts of Implementing Decisions (EU) 2021/2267 and (EU) 2022/162 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 4 February 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
