DECISION OF THE EEA JOINT COMMITTEE No 169/2023

amending Annex XX (Environment) to the EEA Agreement [2023/2566]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Directive (EU) 2023/544 of 16 December 2022 amending Directive 2000/53/EC of the European Parliament and of the Council as regards the exemptions for the use of lead in aluminium alloys for machining purposes, in copper alloys and in certain batteries ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2022/2462 of 14 December 2022 amending Commission Implementing Decision (EU) 2016/2323 establishing the European List of ship recycling facilities pursuant to Regulation (EU) No 1257/2013 of the European Parliament and of the Council ( 2 ) is to be incorporated into the EEA Agreement.

(3) Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XX to the EEA Agreement shall be amended as follows:

The following indent is added in point 32e (Directive 2000/53/EC of the European Parliament and of the Council):

‘–

32023 L 0544 : Commission Delegated Directive (EU) 2023/544 of 16 December 2022 ( OJ L 73, 10.3.2023, p. 5 ).’

The following indent is added in point 32fhd (Commission Implementing Decision (EU) 2016/2323):

‘–

32022 D 2462 : Commission Implementing Decision (EU) 2022/2462 of 14 December 2022 ( OJ L 321, 15.12.2022, p. 42 ).’

Article 2

The texts of Delegated Directive (EU) 2023/544 and Implementing Decision (EU) 2022/2462 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 14 June 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
