DECISION OF THE EEA JOINT COMMITTEE No 9/2021

of 5 February 2021

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/40]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Council Directive 92/65/EEC ( 1 ) was incorporated into the EEA Agreement by Decision of the EEA Joint Committee No 7/94 ( 2 ) .

(2) Directive 92/65/EEC was amended by Regulation (EC) No 998/2003 of the European Parliament and of the Council ( 3 ) , which was incorporated into the EEA Agreement by Decision of the EEA Joint Committee No 92/2005 ( 4 ) . Regulation (EC) No 998/2003 added Article 10(3) to Directive 92/65/EEC to which adaptation (a) to that act refers.

(3) Regulation (EC) No 998/2003 was repealed by Regulation (EU) No 576/2013 of the European Parliament and the Council ( 5 ) , which was incorporated into the EEA Agreement by Decision of the EEA Joint Committee No 66/2016 ( 6 ) . Article 10(3) of Directive 92/65/EEC is therefore no longer applicable and adaptation (a) should therefore be deleted.

(4) This Decision concerns legislation regarding live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. This Decision is therefore not to apply to Iceland.

(5) This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(6) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex I to the EEA Agreement shall be amended as follows:

In Point 9 (Council Directive 92/65/EEC) in Part 4.1:

(a) The text of adaptation (a) is deleted.

(b) Adaptations (b), (c), (d) and (e) are renumbered (a), (b), (c) and (d).

In Point 15 (Council Directive 92/65/EEC) in Part 8.1:

(a) The text of adaptation (a) is deleted.

(b) Adaptations (b), (c), (d) and (e) are renumbered (a), (b), (c) and (d).

Article 2

This Decision shall enter into force on 6 February 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 )

Article 3

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
