DECISION OF THE EEA JOINT COMMITTEE No 74/2021

amending Annex XX (Environment) to the EEA Agreement [2024/80]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2019/1603 of 18 July 2019 supplementing Directive 2003/87/EC of the European Parliament and of the Council as regards measures adopted by the International Civil Aviation Organisation for the monitoring, reporting and verification of aviation emissions for the purpose of implementing a global market-based measure ( 1 ) is to be incorporated into the EEA Agreement.

(2) Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following point is inserted after point 21apl (Commission Implementing Regulation (EU) 2019/1842) of Annex XX to the EEA Agreement:

‘21apm.

32019 R 1603 : Commission Delegated Regulation (EU) 2019/1603 of 18 July 2019 supplementing Directive 2003/87/EC of the European Parliament and of the Council as regards measures adopted by the International Civil Aviation Organisation for the monitoring, reporting and verification of aviation emissions for the purpose of implementing a global market-based measure ( OJ L 250, 30.9.2019, p. 10 ).’

Article 2

The text of Delegated Regulation (EU) 2019/1603 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 6 February 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .

Joint Declaration by the Contracting Parties

to the Decision of the EEA Joint Committee No 74/2021 of 5 February 2021 incorporating Commission Delegated Regulation (EU) 2019/1603 into the EEA Agreement

The Contracting Parties share the understanding that the incorporation into the EEA Agreement of Commission Delegated Regulation (EU) 2019/1603 supplementing Directive 2003/87/EC of the European Parliament and of the Council as regards measures adopted by the International Civil Aviation Organisation for the monitoring, reporting and verification of aviation emissions for the purpose of implementing a global market-based measure is without prejudice to the scope of the EEA Agreement.
