DECISION OF THE EEA JOINT COMMITTEE No 97/2021

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/101]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Decision (EU) 2020/1106 of 24 July 2020 on the organisation of a temporary experiment under Council Directives 66/401/EEC, 66/402/EEC, 2002/54/EC and 2002/57/EC as regards the official checking rate for field inspection under official supervision for basic seed, bred seed of generations prior to basic seed and certified seed ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2020/1401 of 2 October 2020 providing for a temporary derogation from Council Directive 66/401/EEC as regards the requirements for the marketing of certified seed ( 2 ) is to be incorporated into the EEA Agreement.

(3) This Decision concerns legislation regarding phytosanitary matters. Legislation regarding phytosanitary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(4) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following points are inserted after point 62 (Commission Implementing Decision (EU) 2019/160) in Part 2 of Chapter III of Annex I to the EEA Agreement:

Article 2

The texts of Implementing Decisions (EU) 2020/1106 and (EU) 2020/1401 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 20 March 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
