DECISION OF THE EEA JOINT COMMITTEE No 172/2021

amending Annex IX (Financial services) to the EEA Agreement [2024/182]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2020/1272 of 4 June 2020 amending and correcting Delegated Regulation (EU) 2019/979 supplementing Regulation (EU) 2017/1129 of the European Parliament and of the Council with regard to regulatory technical standards on key financial information in the summary of a prospectus, the publication and classification of prospectuses, advertisements for securities, supplements to a prospectus, and the notification portal ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Delegated Regulation (EU) 2020/1273 of 4 June 2020 amending and correcting Delegated Regulation (EU) 2019/980 supplementing Regulation (EU) 2017/1129 of the European Parliament and of the Council as regards the format, content, scrutiny and approval of the prospectus to be published when securities are offered to the public or admitted to trading on a regulated market ( 2 ) is to be incorporated into the EEA Agreement.

(3) Annex IX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex IX to the EEA Agreement shall be amended as follows:

The following is added in point 29bda (Commission Delegated Regulation (EU) 2019/979):

‘, as amended by:

— 32020 R 1272 : Commission Delegated Regulation (EU) 2020/1272 of 4 June 2020 ( OJ L 300, 14.9.2020, p. 1 ).

The provisions of the Delegated Regulation shall, for the purposes of this Agreement, be read with the following adaptation:

In Article 22a, as regards the EFTA States, the words “ 16 September 2020 ” shall read “the day before the date of entry into force of Decision of the EEA Joint Committee No 172/2021 of 11 June 2021 ”.’

The following is added in point 29bdb (Commission Delegated Regulation (EU) 2019/980):

‘, as amended by:

— 32020 R 1273 : Commission Delegated Regulation (EU) 2020/1273 of 4 June 2020 ( OJ L 300, 14.9.2020, p. 6 ).

The provisions of the Delegated Regulation shall, for the purposes of this Agreement, be read with the following adaptation:

In Article 46a, as regards the EFTA States, the words “ 16 September 2020 ” shall read “the day before the date of entry into force of Decision of the EEA Joint Committee No 172/2021 of 11 June 2021 ”.’

Article 2

The texts of Delegated Regulations (EU) 2020/1272 and (EU) 2020/1273 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 12 June 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
