DECISION OF THE EEA JOINT COMMITTEE No 231/2021

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/464]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2021/880 of 5 March 2021 amending Delegated Regulation (EU) 2020/686 supplementing Regulation (EU) 2016/429 of the European Parliament and the Council as regards the traceability, animal health and certification requirements for movements within the Union of germinal products of certain kept terrestrial animals ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2021/520 of 24 March 2021 laying down rules for the application of Regulation (EU) 2016/429 of the European Parliament and of the Council with regard to the traceability of certain kept terrestrial animals ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2021/620 of 15 April 2021 laying down rules for the application of Regulation (EU) 2016/429 of the European Parliament and of the Council as regards the approval of the disease-free and non-vaccination status of certain Member States or zones or compartments thereof as regards certain listed diseases and the approval of eradication programmes for those listed diseases ( 3 ) is to be incorporated into the EEA Agreement.

(4) Implementing Regulation (EU) 2021/620 repeals Commission Regulation (EC) No 616/2009 ( 4 ) , Commission Decisions 93/52/EEC ( 5 ) , 94/963/EC ( 6 ) , 95/98/EC ( 7 ) , 2003/467/EC ( 8 ) , 2004/558/EC ( 9 ) , 2008/185/EC ( 10 ) and 2009/177/EC ( 11 ) and Commission Implementing Decision 2013/503/EU ( 12 ) which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(5) This Decision concerns, inter alia, legislation regarding live animals other than fish and aquaculture animals and animal products such as ova, embryo and semen. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. This Decision is therefore to apply to Iceland for the areas referred to in paragraph 2 of the Introductory Part.

(6) This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(7) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex I to the EEA Agreement is amended as follows:

The following is added in point 13c (Commission Delegated Regulation (EU) 2020/686) in Part 1.1:

‘, as amended by:

— 32021 R 0880 : Commission Delegated Regulation (EU) 2021/880 of 5 March 2021 ( OJ L 194, 2.6.2021, p. 1 ).’

The following is inserted after point 13p (Commission Implementing Regulation (EU) 2021/403) in Part 1.1:

‘13q.

32021 R 0520 : Commission Implementing Regulation (EU) 2021/520 of 24 March 2021 laying down rules for the application of Regulation (EU) 2016/429 of the European Parliament and of the Council with regard to the traceability of certain kept terrestrial animals ( OJ L 104, 25.3.2021, p. 39 ).

This act applies to Iceland for the areas referred to in paragraph 2 of the Introductory Part.

32021 R 0620 : Commission Implementing Regulation (EU) 2021/620 of 15 April 2021 laying down rules for the application of Regulation (EU) 2016/429 of the European Parliament and of the Council as regards the approval of the disease-free and non-vaccination status of certain Member States or zones or compartments thereof as regards certain listed diseases and the approval of eradication programmes for those listed diseases ( OJ L 131, 16.4.2021, p. 78 ).

This act applies to Iceland for the areas referred to in paragraph 2 of the Introductory Part.’

The texts of points 43 (Commission Regulation (EC) No 616/2009) in Part 3.2, 14 (Commission Decision 93/52/EEC), 25 (Commission Decision 94/963/EC), 26 (Commission Decision 95/98/EC), 70 (Commission Decision 2003/467/EC), 80 (Commission Decision 2004/558/EC), 84 (Commission Decision 2008/185/EC) and 89 (Commission Decision 2009/177/EC) in Part 4.2 and 59 (Commission Implementing Decision 2013/503/EU) in Part 7.2 are deleted.

Article 2

The text of Delegated Regulation (EU) 2021/880 in the Norwegian language and the texts of Implementing Regulations (EU) 2021/520 and (EU) 2021/620 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 25 September 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
