EU - Rechtsakte: 18 Common Foreign and Security Policy

COUNCIL DECISION (CFSP) 2021/1143

of 12 July 2021

on a European Union Military Training Mission in Mozambique (EUTM Mozambique)

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Articles 42(4) and 43(2) thereof,
Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,
Whereas:
(1) In its conclusions of 22 April 2020, the Council provided a comprehensive framework for Union and Member States’ engagement with Mozambique and coordination with other stakeholders. In particular, the Council emphasised that the security and humanitarian situation in Cabo Delgado requires urgent attention, while ensuring full respect for human rights.
(2) On 30 March 2021, the Political and Security Committee (PSC) endorsed a Political Framework for Crisis Approach in Cabo Delgado and considered that a Common Security and Defence Policy (CSDP) action would be appropriate, focused on training of, and assistance to, the Mozambican armed forces, in the context of the Union’s Integrated Approach for the crisis in Cabo Delgado.
(3) By letter dated 3 June 2021, the President of Mozambique welcomed the deployment of a Union non-executive CSDP mission in Mozambique, in order to help build the capacity of the Mozambican defence and security forces to respond more efficiently to security and humanitarian risks in Cabo Delgado.
(4) On 28 June 2021, the Council approved a Crisis Management Concept for a possible CSDP military training mission in Mozambique, in conjunction with a possible assistance measure to provide equipment other than military equipment, or platforms, designed to deliver lethal force, in order to support the Mozambican armed forces with a view to their deployment in Cabo Delgado. That Concept underlined that the envisaged CSDP mission should be one of the tools in the Union’s Integrated Approach for the crisis in Cabo Delgado in conjunction with support to peacebuilding, conflict prevention and dialogue support, humanitarian assistance and development cooperation, as well as the promotion of the Women, Peace and Security Agenda. That Concept further stressed the Union’s political-strategic objective to support the deployment of professionalised Mozambican defence and security forces, enabling the presence of accountable law enforcement agencies in order to protect the civilian population, and to allow accountable State structures to return to, and deliver their services across, Cabo Delgado. In this context, the Council takes note of the Joint Communication of the European Commission and the High Representative (HR) on the EU Gender Action Plan (GAP) III.
(5) The PSC should exercise, under the responsibility of the Council and of the HR, political control over the CSDP military training mission in Mozambique (EUTM Mozambique), provide it with strategic direction and take the relevant decisions in accordance with the third paragraph of Article 38 of the Treaty on European Union (TEU).
(6) It is necessary to negotiate and conclude international agreements as regards the status of Union-led units and personnel and the participation of third States in EUTM Mozambique.
(7) Pursuant to Article 41(2) TEU and in accordance with Council Decision (CFSP) 2021/509 (1) establishing the European Peace Facility, the operating expenditure arising from this Decision which has military or defence implications is to be borne by the Member States.
(8) In accordance with Article 5 of Protocol No 22 on the position of Denmark annexed to the TEU and to the Treaty on the Functioning of the European Union (TFEU), Denmark does not participate in the elaboration and implementation of decisions and actions of the Union which have defence implications. Consequently, Denmark is not participating in the adoption of this Decision, is neither bound by it nor subject to its application, and does not participate in the financing of this operation,
HAS ADOPTED THIS DECISION:
