DECISION OF THE EEA JOINT COMMITTEE No 82/2022

amending Annex XX (Environment) to the EEA Agreement [2022/1150]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2021/941 of 10 June 2021 laying down a specific procedure for identifying heavy-duty vehicles certified as vocational vehicles but not registered as such and applying corrections to the annual average specific CO 2 emissions of a manufacturer to take those vehicles into account  ( 1 ) is to be incorporated into the EEA Agreement.

(2) By virtue of Decision of the EEA Joint Committee No 398/2021 of 10 December 2021, Regulation (EU) 2019/1242 does not apply to Liechtenstein.

(3) Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following point is inserted after point 21azkc (Commission Delegated Regulation (EU) 2021/1430) of Annex XX to the EEA Agreement:

‘21azkd.

32021 R 0941 : Commission Implementing Regulation (EU) 2021/941 of 10 June 2021 laying down a specific procedure for identifying heavy-duty vehicles certified as vocational vehicles but not registered as such and applying corrections to the annual average specific CO 2 emissions of a manufacturer to take those vehicles into account ( OJ L 205, 11.6.2021, p. 77 ).’

Article 2

The text of Implementing Regulation (EU) 2021/941 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 19 March 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( * ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 396/2021 of 10 December 2021  ( 2 ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 398/2021 of 10 December 2021  ( 3 ) , whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
