DECISION OF THE EEA JOINT COMMITTEE No 55/2022

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2022/1123]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1) Regulation (EU) 2019/2144 of the European Parliament and of the Council of 27 November 2019 on type-approval requirements for motor vehicles and their trailers, and systems, components and separate technical units intended for such vehicles, as regards their general safety and the protection of vehicle occupants and vulnerable road users, amending Regulation (EU) 2018/858 of the European Parliament and of the Council and repealing Regulations (EC) No 78/2009, (EC) No 79/2009 and (EC) No 661/2009 of the European Parliament and of the Council and Commission Regulations (EC) No 631/2009, (EU) No 406/2010, (EU) No 672/2010, (EU) No 1003/2010, (EU) No 1005/2010, (EU) No 1008/2010, (EU) No 1009/2010, (EU) No 19/2011, (EU) No 109/2011, (EU) No 458/2011, (EU) No 65/2012, (EU) No 130/2012, (EU) No 347/2012, (EU) No 351/2012, (EU) No 1230/2012 and (EU) 2015/166  ( 1 ) , as corrected by OJ L 398, 11.11.2021, p. 29 , is to be incorporated into the EEA Agreement.

(2) Regulation (EU) 2019/2144 repeals, with effect from 6 July 2022, Regulations (EC) No 78/2009  ( 2 ) , (EC) No 79/2009  ( 3 ) and (EC) No 661/2009  ( 4 ) of the European Parliament and of the Council and Commission Regulations (EC) No 631/2009  ( 5 ) , (EU) No 406/2010  ( 6 ) , (EU) No 672/2010  ( 7 ) , (EU) No 1003/2010  ( 8 ) , (EU) No 1005/2010  ( 9 ) , (EU) No 1008/2010  ( 10 ) , (EU) No 1009/2010  ( 11 ) , (EU) No 19/2011  ( 12 ) , (EU) No 109/2011  ( 13 ) , (EU) No 458/2011  ( 14 ) , (EU) No 65/2012  ( 15 ) , (EU) No 130/2012  ( 16 ) , (EU) No 347/2012  ( 17 ) , (EU) No 351/2012  ( 18 ) , (EU) No 1230/2012  ( 19 ) and (EU) 2015/166  ( 20 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement with effect from 6 July 2022.

(3) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex II to the EEA Agreement shall be amended as follows:

(1) The following indent is added in point 51 (Regulation (EU) 2018/858 of the European Parliament and of the Council):

‘—

(2) The following point is inserted after point 51c (Commission Implementing Regulation (EU) 2021/133):

‘52.

(3) The text of points 45zy (Regulation (EC) No 78/2009 of the European Parliament and of the Council), 45zz (Commission Regulation (EC) No 631/2009), 45zza (Regulation (EC) No 661/2009 of the European Parliament and of the Council), 45zzb (Commission Regulation (EU) No 672/2010), 45zzc (Commission Regulation (EU) No 1003/2010), 45zzd (Commission Regulation (EU) No 1005/2010), 45zze (Commission Regulation (EU) No 1008/2010), 45zzf (Commission Regulation (EU) No 1009/2010), 45zzg (Commission Regulation (EU) No 19/2011), 45zzh (Commission Regulation (EU) No 109/2011), 45zzi (Commission Regulation (EU) No 458/2011), 45zzj (Regulation (EC) No 79/2009 of the European Parliament and of the Council), 45zzm (Commission Regulation (EU) No 406/2010), 45zzn (Commission Regulation (EU) No 130/2012), 45zzo (Commission Regulation (EU) No 65/2012), 45zzp (Commission Regulation (EU) No 347/2012), 45zzq (Commission Regulation (EU) No 351/2012) and 45zzu (Commission Regulation (EU) No 1230/2012) of Chapter I of Annex II to the EEA Agreement shall be deleted with effect from 6 July 2022.

Article 2

The text of Regulation (EU) 2019/2144, as corrected by OJ L 398, 11.11.2021, p. 29 , in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 19 March 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( * ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 49/2022 of 18 March 2022  ( 21 ) , whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
