DECISION OF THE EEA JOINT COMMITTEE No 147/2022

amending Annex IX (Financial services) to the EEA Agreement [2022/1591]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Decision (EU) 2022/174 of 8 February 2022 determining, for a limited period of time, that the regulatory framework applicable to central counterparties in the United Kingdom of Great Britain and Northern Ireland is equivalent, in accordance with Regulation (EU) No 648/2012 of the European Parliament and of the Council  ( 1 ) is to be incorporated into the EEA Agreement.

Commission Implementing Decisions (EU) 2018/2031  ( 2 ) , (EU) 2019/544  ( 3 ) and (EU) 2019/2211  ( 4 ) , which are incorporated into the EEA Agreement, have become obsolete and are consequently to be repealed under the EEA Agreement.

(3)

Commission Implementing Decision (EU) 2020/1308, which is incorporated into the EEA Agreement, will expire on 30 June 2022 and is consequently to be repealed under the EEA Agreement with effect from 1 July 2022.

Annex IX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex IX to the EEA Agreement shall be amended as follows:

1.

The text of point 31bcaw (Commission Implementing Decision (EU) 2018/2031) is replaced by the following:

‘ 32022 D 0174:

Commission Implementing Decision (EU) 2022/174 of 8 February 2022 determining, for a limited period of time, that the regulatory framework applicable to central counterparties in the United Kingdom of Great Britain and Northern Ireland is equivalent, in accordance with Regulation (EU) No 648/2012 of the European Parliament and of the Council ( OJ L 28, 9.2.2022, p. 40 ).’

The text of point 31bcay (Commission Implementing Decision (EU) 2020/1308) shall be deleted with effect from 1 July 2022.

Article 2

The text of Implementing Decision (EU) 2022/174 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 30 April 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( * ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
