DECISION OF THE EEA JOINT COMMITTEE No 129/2022

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2022/1573]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2021/1449 of 3 September 2021 amending Implementing Regulation (EU) No 540/2011 as regards the extension of the approval periods of the active substances 2-phenylphenol (including its salts such as the sodium salt), 8-hydroxyquinoline, amidosulfuron, bifenox, chlormequat, chlorotoluron, clofentezine, clomazone, cypermethrin, daminozide, deltamethrin, dicamba, difenoconazole, diflufenican, dimethachlor, etofenprox, fenoxaprop-P, fenpropidin, fludioxonil, flufenacet, fosthiazate, indoxacarb, lenacil, MCPA, MCPB, nicosulfuron, paraffin oils, paraffin oil, penconazole, picloram, propaquizafop, prosulfocarb, quizalofop-P-ethyl, quizalofop-P-tefuryl, sulphur, tetraconazole, tri-allate, triflusulfuron and tritosulfuron  ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2021/1451 of 3 September 2021 concerning the non-approval of dimethyl sulphide as a basic substance in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market  ( 2 ) is to be incorporated into the EEA Agreement.

(3) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XV of Annex II to the EEA Agreement shall be amended as follows:

(1) the following indent is added in point 13a (Commission Implementing Regulation (EU) No 540/2011):

‘—

32021 R 1449 : Commission Implementing Regulation (EU) 2021/1449 of 3 September 2021 ( OJ L 313, 6.9.2021, p. 20 ).’;

(2) the following point is inserted after point 13zzzzzzzzzzzze (Commission Implementing Regulation (EU) 2021/1455):

‘13zzzzzzzzzzzzf.

32021 R 1451 : Commission Implementing Regulation (EU) 2021/1451 of 3 September 2021 concerning the non-approval of dimethyl sulphide as a basic substance in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market ( OJ L 313, 6.9.2021, p. 28 ).’.

Article 2

The texts of Implementing Regulations (EU) 2021/1449 and (EU) 2021/1451 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 30 April 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( * ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
