DECISION OF THE EEA JOINT COMMITTEE No 197/2022
of 10 June 2022
amending Annex XVII (Intellectual property) to the EEA Agreement [2022/1897]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:

Regulation (EU) 2019/933 of the European Parliament and of the Council of 20 May 2019 amending Regulation (EC) No 469/2009 concerning the supplementary protection certificate for medicinal products ( 1 ) is to be incorporated into the EEA Agreement.
(2)
By virtue of Decision of the EEA Joint Committee No 92/2017 of 5 May 2017 ( 2 ) , Liechtenstein shall not deliver any supplementary protection certificates for medicinal products as laid down in Regulation (EC) No 469/2009 of the European Parliament and of the Council ( 3 ) . Therefore, Regulation (EU) 2019/933 does not apply to Liechtenstein.

Annex XVII to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
Point 6 (Regulation (EC) No 469/2009 of the European Parliament and of the Council) of Annex XVII to the EEA Agreement shall be amended as follows:
1.
The following is added:
‘, as amended by,

32019 R 0933 : Regulation (EU) 2019/933 of the European Parliament and of the Council of 20 May 2019 ( OJ L 153, 11.6.2019, p. 1 ).’
2.
Adaptations (a) to (c) are renumbered as adaptations (b) to (d), respectively.
3.
The following adaptation is inserted before adaptation (b):
‘(a)
In Article 5(10), as regards the EFTA States, the words “1 July 2019” shall read “the date of entry into force of Decision of the EEA Joint Committee No 197/2022 of 10 June 2022”.’
4.
The following adaptation is inserted after adaptation (d):
‘(e)
As regards the EFTA States, Annex -I shall read as follows:
“ Logo
This logo shall appear in black and in such a size as to be sufficiently visible.

Article 2
The text of Regulation (EU) 2019/933 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.
Article 3
This Decision shall enter into force on 11 June 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( * ) .
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
