DECISION OF THE EEA JOINT COMMITTEE No 165/2022

of 10 June 2022

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2022/1865]

THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:
(1) Commission Delegated Regulation (EU) 2021/2168 of 21 September 2021 amending Delegated Regulation (EU) 2019/2035 supplementing Regulation (EU) 2016/429 of the European Parliament and of the Council, as regards rules for establishments keeping terrestrial animals and hatcheries, and the traceability of certain kept terrestrial animals and hatching eggs  ( 1 ) is to be incorporated into the EEA Agreement.
(2) Commission Delegated Regulation (EU) 2022/54 of 21 October 2021 amending Delegated Regulation (EU) 2020/692 as regards additional requirements for the entry into the Union of certain ungulates which originate in the Union, are moved to a third country or territory to participate in events, exhibitions, displays and shows and are then moved back to the Union  ( 2 ) is to be incorporated into the EEA Agreement.
(3) Commission Implementing Regulation (EU) 2021/1911 of 27 October 2021 amending Annex II to Implementing Regulation (EU) 2021/620 as regards the disease-free status of the Autonomous Community of Galicia and the Autonomous Community of Principado de Asturias in Spain from infection with Mycobacterium tuberculosis complex, amending Annex VIII thereto as regards the disease-free status of Autonomous Community of Islas Baleares, Huelva and Sevilla provinces and the regions of Azuaga, Badajoz, Mérida, Jerez de los Caballeros and Zafra in Badajoz province in Spain and Alentejo region and Santarém district in Lisboa e Vale do Tejo region in Portugal from infection with bluetongue virus, amending Annex IX thereto as regards the disease-free status of the Åland islands in Finland from infestation with Varroa spp and amending Annex XIII thereto as regards the disease-free status of Denmark and Finland regarding Infectious haematopoietic necrosis  ( 3 ) is to be incorporated into the EEA Agreement.
(4) This Decision concerns, inter alia , legislation regarding live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement.
(5) This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.
(6) Annex I to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:

Article 1

Part 1.1 of Chapter I of Annex I to the EEA Agreement shall be amended as follows:
(1) The following indent is added in point 13f (Commission Delegated Regulation (EU) 2020/692):

(2) The following indent is added in point 13g (Commission Delegated Regulation (EU) 2019/2035):

32021 R 2168 : Commission Delegated Regulation (EU) 2021/2168 of 21 September 2021 ( OJ L 438, 8.12.2021, p. 38 ).’
(3) The following indent is added in point 13r (Commission Implementing Regulation (EU) 2021/620):
‘—
32021 R 1911 : Commission Implementing Regulation (EU) 2021/1911 of 27 October 2021 ( OJ L 389, 4.11.2021, p. 2 ).’

Article 2

The texts of Delegated Regulation (EU) 2021/2168 and Implementing Regulation (EU) 2021/1911 in the Icelandic and Norwegian languages and Delegated Regulation (EU) 2022/54 in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 11 June 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( * ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
