DECISION OF THE EEA JOINT COMMITTEE No 224/2022

of 8 July 2022

amending Annex XXI (Statistics) to the EEA Agreement [2023/641]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Regulation (EU) 2019/1700 of the European Parliament and of the Council of 10 October 2019 establishing a common framework for European statistics relating to persons and households, based on data at individual level collected from samples, amending Regulations (EC) No 808/2004, (EC) No 452/2008 and (EC) No 1338/2008 of the European Parliament and of the Council, and repealing Regulation (EC) No 1177/2003 of the European Parliament and of the Council and Council Regulation (EC) No 577/98 ( 1 ) is to be incorporated into the EEA Agreement.

(2) For practical reasons, the points under the heading “DEMOGRAPHICAL AND SOCIAL STATISTICS” in Annex XXI to the EEA Agreement should be renumbered.

(3) Regulation (EU) 2019/1700 repeals Regulation (EC) No 1177/2003 of the European Parliament and of the Council ( 2 ) and Council Regulation (EC) No 577/98 ( 3 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(4) Regulation (EU) 2019/1700 implicitly repeals Commission Regulation (EC) No 2104/2002 ( 4 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(5) Commission Regulation (EC) No 388/2005 ( 5 ) , which is incorporated into the EEA Agreement, expired on 31 December 2016 and consequently the reference thereto should be deleted from the EEA Agreement.

(6) Commission Regulation (EC) No 102/2007 ( 6 ) , which is incorporated into the EEA Agreement, expired on 31 December 2008 and consequently the reference thereto should be deleted from the EEA Agreement.

(7) Annex XXI to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The points under the heading “DEMOGRAPHICAL AND SOCIAL STATISTICS” in Annex XXI to the EEA Agreement shall be renumbered as follows:

Point 18 (Regulation (EC) No 862/2007 of the European Parliament and of the Council) is renumbered as point 18a, and points 18aq (Commission Regulation (EU) No 351/2010) and 18as (Commission Regulation (EU) No 216/2010) are renumbered as points 18aa and 18ab.

Point 18z3 (Regulation (EU) No 1260/2013 of the European Parliament and of the Council) is renumbered as point 18p, and point 18z5 (Commission Implementing Regulation (EU) No 205/2014) as point 18pa.

Article 2

Annex XXI to the EEA Agreement shall be amended as follows:

The following is inserted after point 18pa (Commission Implementing Regulation (EU) No 205/2014):

‘18q.

32019 R 1700 : Regulation (EU) 2019/1700 of the European Parliament and of the Council of 10 October 2019 establishing a common framework for European statistics relating to persons and households, based on data at individual level collected from samples, amending Regulations (EC) No 808/2004, (EC) No 452/2008 and (EC) No 1338/2008 of the European Parliament and of the Council, and repealing Regulation (EC) No 1177/2003 of the European Parliament and of the Council and Council Regulation (EC) No 577/98 ( OJ L 261I, 14.10.2019, p. 1 ).

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptations:

(a) The EFTA States shall not be bound by the regional breakdown of data as required by this Regulation.

(b) In Article 19(5), as regards the EFTA States, the words “by 4 February 2020” are replaced by the words “within three months of the date of entry into force of Decision of the EEA Joint Committee No 224/2022 of 8 July 2022”.

The following is added in points 18m (Regulation (EC) No 452/2008 of the European Parliament and of the Council) and 18o (Regulation (EC) No 1338/2008 of the European Parliament and of the Council):

‘, as amended by:

The following indent is added in point 28 (Regulation (EC) No 808/2004 of the European Parliament and of the Council):

The texts of points 18b (Council Regulation (EC) No 577/98), 18bc (Commission Regulation (EC) No 2104/2002), 18bh (Commission Regulation (EC) No 388/2005), 18bk (Commission Regulation (EC) No 102/2007), 18i (Regulation (EC) No 1177/2003) are deleted.

Article 3

The text of Regulation (EU) 2019/1700 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 4

This Decision shall enter into force on 9 July 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( * ) .

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
