Premessa

UMBERTO DI SAVOIA Principe di Piemonte Luogotenente Generale del Regno In virtu' dell'autorita' a Noi delegata; Vista la legge 3 aprile 1926, n. 563 , sulla disciplina giuridica dei rapporti collettivi di lavoro, nonche' il R. decreto 1° luglio 1926, n. 1130 , contenente norme per l'attuazione della legge predetta, e le successive modificazioni; Visto il decreto-legge Luogotenenziale 25 giugno 1944, n. 151 , relativo all'assemblea per la nuova costituzione dello Stato, al giuramento dei membri del Governo e alla facolta' del Governo di emanare norme giuridiche; Visto il R. decreto-legge 30 ottobre 1943, n. 2/B , modificato con R. decreto-legge 29 maggio 1944, n. 141 , riguardante la sospensione delle norme relative all'emanazione, promulgazione, registrazione e pubblicazione di Regi decreti e di altri provvedimenti; Vista la deliberazione del Consiglio dei Ministri; Sulla proposta dei Ministro per l'industria, commercio e lavoro, di concerto con il Ministro per l'interno, con quello per la grazia e giustizia, con quello per le finanze e con quello per il tesoro; Abbiamo sanzionato e promulghiamo quanto segue:

Il D.Lgs. del Capo Provvisorio dello Stato 1 dicembre 1947, n. 1611 ha disposto (con l'art. 5, comma 1) che " Le operazioni di liquidazione degli enti indicati all' art. 1 del decreto legislativo luogotenenziale 23 novembre 1944, n. 369 , dovranno essere chiuse entro tre mesi dalla data di entrata, in vigore del presente decreto".

Art. 43

Per i rapporti collettivi ed individuali, restano in vigore, salvo le successive modifiche, le norme contenute nei contratti collettivi, negli accordi economici, nelle sentenze della Magistratura del lavoro e nelle ordinanze corporative di cui agli articoli 10 e 13 della legge 3 aprile 1926, n. 563 , agli articoli 8 e 11 della legge 5 febbraio 1934, n. 163 , e agli articoli 4 e 5 del R. decreto-legge 9 agosto 1943, n. 721 .

Il D.Lgs. 13 dicembre 2010, n. 212 ha disposto (con l'art. 1, comma 1) l'abrogazione del presente provvedimento a decorrere dal 16 dicembre 2010.

Successivamente il D.L. 6 luglio 2011, n. 98 , convertito con modificazioni dalla L. 15 luglio 2011, n. 111 , nel modificare l'allegato 1 al D.Lgs. 13 dicembre 2010, n. 212 , ha conseguentemente disposto (con l'art. 18, comma 17) il venir meno dell'efficacia abrogativa del presente articolo con effetto dal 16 dicembre 2010.

Ordiniamo, a chiunque spetti, di osservare il presente decreto e di farlo osservare come legge dello Stato.
